As of August 2006, a ban is in place on the sale of any product containing ephedra-alkaloids and ephedrine that has not been specifically approved by the FDA.
In other words, there are still plenty of FDA approved products, specifically OTC asthma meds like Bronkaid, that are still very legal to buy. You just need to fill out an id form.

I don't know, things are different in Canada (surprise surprise). Here you can buy Ephedrine HCL but only in 8mg tabs.
The "traditional" fat burner is the goold old ECA stack (ephedra, caffeine & aspirin) and you can do a homemade version of the proper ratio or even just ask for stuff that most stores keep under the counter (like red devils or whatever). What makes a fatburner "better" is really individual thing. Firstly, diet and training MUST be in check. Second, is what you can tolerate. Third is just what you like----some like feeling wired and some don't. Always start with the absolutel minimum to guage your tolerance. It's really important to cycle OFF them----being on them forever can cause adrenal burnout (more common with chicks than guys). We're talking for years at a time. I would say 8-12 weeks straight is enough and you should take a break after.
