I guarantee there will be more than just a citation. Could be reckless homicide, recklessness with a vehicle causing death. There are several charges that will be brought up.
And yes, Im sorry to hear about your friend. It does hit home no matter where an officer gets killed from. I remember almost getting hit by a huge Dodge pick-up while I was performing a traffic stop. I nearly climbed into the window of the vehicle I stopped. I felt the air from the truck real strong on my back. Needless to say I didnt ticket the guy I stopped but I radioed in what happened and an officer from the next town got that truck stopped and was issued a couple citations and got a good butt chewing.

Dang bro. THat is really sad. I'm sorry for your loss of a friend.
My sister's fiancee was killed by a lady who ran a stop sign. She got a ticket for running a stop sign. Although she wasn't out to hurt anyone, she deserved a huge fine a a license revocation AT MINIMUM. She should have been charged with manslaughter IMO. I don't necessarily believe her punishment should have been a prison sentence, but she needed to know that she royally ****ed up peoples lives. Although I'm sure she feels guilty about killing someone, she got a fine for $150. That doesn't mean ****. If I had 1,000,000,000,000,000,000 Dollars I'd pay it to save someone's life that I care about. My condolonces

I'm so sorry to hear about this. I'm sure it is very hard to deal with. My thoughts are with you and his family! My husband wanted to go into law enforcement at one time and it scared the daylights out of me..... so sad that something like this happened at a ROUTINE traffic stop, all because someone wasn't paying attention....

If that was our department, the protocol would of been to first and foremost, do a breath test for any type of alcohol and do field sobriety tests, license check, then transport her to the hospital for a blood draw to determine if she was under the influence of alcohol or drugs. If she was under the influence, then its a C felony possibly B felony if it was within the past 5 years.
If she wasnt under the influence, the accident reconstruction team would be working overtime to get all the facts straight. Unfortunately if she had a valid license, no drugs or alcohol in system, and she stopped and cooperated with the police, then there really is no legal charge to bring her up on reference just being an accident causing death. Not saying thats right, but that's how the law works here in Indiana. However, with that being said there is another infraction you could and should write and that is failure to yield to an emergency vehicle. By state law, it requires a driver to move into the far lane if possible and/or slow speed down to a safe speed when passing the emergency vehicles that are stopped on the road. You could also write her for unsafe speed maybe. She could also be charged with Involuntary Manslaughter which is a D Felony. She could also be charged with Criminal Recklessness with a vehicle which is a C Felony since it resulted in death. If your prosecutor doesnt at least try to go for one of these felony charges then I have to say that is pathetic. And remember this, the prosecutor is an elected official so when his term is up for re-election, vote in someone else. Again, sorry for the loss. Im just trying to clarify the way the law reads in reference to this type of incident.
